Yachtwize is a digital platform serving the marine and yachting industry.

The Platform may include:

• Maritime business directory listings
• Service provider profiles
• Yacht-related news and articles
• Industry content and resources
• Membership subscriptions
• Advertising opportunities
• Lead generation tools
• Business promotion services
• Industry networking features
• Future software tools and integrations

Yachtwize operates solely as a technology and information platform.

Unless explicitly stated otherwise, Yachtwize is not:

• A yacht broker
• A yacht charter operator
• A marine contractor
• A marina operator
• An insurer
• A financial institution
• An escrow service
• A party to any transaction between users

To use the Platform, you must:

• Be at least 18 years old;
• Have legal capacity to enter into binding agreements;
• Comply with all applicable laws and regulations;
• Provide accurate and complete information.

If you are registering or listing a business on behalf of a company, you represent that you have authority to bind that company to these Terms.

Certain Platform features require account registration.

You agree to:

• Provide accurate information;
• Maintain current account details;
• Keep login credentials confidential;
• Accept responsibility for activities conducted through your account.

You must immediately notify Yachtwize of any unauthorized access or security breach.

We reserve the right to suspend, restrict, or terminate accounts at our discretion if we believe these Terms have been violated.

Businesses may create directory profiles and listings on Yachtwize.

By submitting a listing, you represent and warrant that:

• You are authorized to represent the business;
• All information is accurate and current;
• The business operates legally;
• The listing does not infringe any third-party rights;
• The listing complies with UAE laws and regulations.

You remain solely responsible for all information submitted to the Platform.

Yachtwize does not independently verify the accuracy, licensing, qualifications, certifications, insurance coverage, or legal status of listed businesses.

Users should perform their own due diligence before engaging with any listed company.

Yachtwize may offer paid memberships, enhanced listings, promotional packages, advertising products, and other subscription services.

Membership benefits may include:

• Enhanced directory visibility
• Featured placement
• Lead generation tools
• Analytics access
• Marketing opportunities
• Additional profile functionality
• Content publishing privileges

Subscription benefits may change from time to time as the Platform evolves.

Unless otherwise stated:

• Membership fees are billed in advance;
• Fees are non-refundable;
• Subscriptions automatically renew unless cancelled before renewal;
• Yachtwize may modify pricing with reasonable notice.

Failure to pay fees may result in suspension or removal of associated services.

Users may submit:

• Business information
• Images
• Logos
• Videos
• Reviews
• Articles
• Comments
• News submissions
• Marketing content
• Other materials ("User Content")

You retain ownership of your User Content.

However, by submitting User Content, you grant Yachtwize a worldwide, royalty-free, transferable, sublicensable, non-exclusive license to:

• Display;
• Publish;
• Store;
• Modify;
• Reformat;
• Reproduce;
• Distribute;
• Promote;

such content in connection with operating, marketing, improving, and expanding the Platform.

This license continues for as long as the content remains on the Platform and for any archived or backup copies maintained for legal, operational, or compliance purposes.

You agree not to upload, publish, distribute, or submit content that:

• Is false or misleading;
• Violates applicable laws;
• Infringes intellectual property rights;
• Contains defamatory material;
• Promotes illegal activities;
• Contains malware or malicious code;
• Harasses, threatens, or abuses others;
• Contains obscene, discriminatory, or offensive material;
• Misrepresents affiliations or credentials.

Yachtwize reserves the right to review, edit, reject, suspend, or remove content at any time without prior notice.

Users may submit reviews or ratings where available.

Reviews must:

• Be based on genuine experiences;
• Be truthful and accurate;
• Not contain defamatory statements;
• Not be manipulated through incentives or fake accounts.

Yachtwize reserves the right to moderate, remove, or disable reviews that violate these Terms.

We do not guarantee the accuracy of reviews posted by users.

Businesses may purchase advertising, featured placements, sponsored articles, or promotional opportunities.

Yachtwize does not guarantee:

• Specific rankings;
• Search visibility;
• Traffic volumes;
• Leads;
• Sales;
• Business outcomes.

Advertising performance depends on numerous factors outside our control.

All advertising fees are non-refundable unless otherwise agreed in writing.

The Platform provides information for informational and discovery purposes only.

Yachtwize does not guarantee:

• Accuracy;
• Completeness;
• Reliability;
• Availability;
• Quality of services offered by listed companies.

Any engagement between users and listed businesses is conducted entirely at the user's own risk.

Yachtwize is not responsible for:

• Service quality;
• Contract disputes;
• Payment disputes;
• Delays;
• Damages;
• Misrepresentations;
• Professional negligence by listed businesses.

Yachtwize may facilitate introductions, inquiries, leads, and business connections.

However:

• Yachtwize is not a party to any transaction;
• Yachtwize does not supervise contractual relationships;
• Yachtwize does not guarantee performance by any party.

Any agreement entered into between users or businesses remains solely between those parties.

All Yachtwize branding, software, databases, designs, graphics, content, trademarks, logos, and platform functionality remain the exclusive property of Yachtwize or its licensors.

You may not:

• Copy;
• Republish;
• Sell;
• Reverse engineer;
• Modify;
• Distribute;

any portion of the Platform without prior written permission.

You agree not to:

• Use the Platform unlawfully;
• Scrape or extract directory data;
• Circumvent membership fees;
• Interfere with Platform operations;
• Create fake accounts;
• Impersonate others;
• Transmit malware;
• Conduct spam campaigns;
• Harvest user information;
• Misrepresent your business.

Violation may result in immediate suspension or permanent removal.

The Platform may contain links to third-party websites, software, products, or services.

Yachtwize does not control or endorse third-party content and accepts no responsibility for:

• Third-party services;
• Website availability;
• Content accuracy;
• Privacy practices;
• Business dealings.

Users access third-party resources at their own risk.

Use of the Platform is also governed by the Yachtwize Privacy Policy.

By using the Platform, you consent to the collection, processing, and storage of information as described within the Privacy Policy.

Yachtwize aims to maintain uninterrupted service but does not guarantee:

• Continuous availability;
• Error-free operation;
• Complete security;
• Compatibility with all devices.

We may suspend or modify portions of the Platform for maintenance, upgrades, security measures, or operational reasons.

The Platform is provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, Yachtwize disclaims all warranties, whether express or implied, including:

• Merchantability;
• Fitness for a particular purpose;
• Non-infringement;
• Availability;
• Reliability;
• Accuracy.

We do not guarantee any business, marketing, networking, or financial results from use of the Platform.

To the fullest extent permitted by applicable law, Yachtwize, its directors, officers, employees, affiliates, and partners shall not be liable for:

• Indirect damages;
• Consequential damages;
• Lost profits;
• Lost opportunities;
• Business interruption;
• Data loss;
• Reputational damage.

Where liability cannot be excluded, Yachtwize's maximum aggregate liability shall not exceed the amount paid by the user to Yachtwize during the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless Yachtwize, its affiliates, directors, officers, employees, contractors, and partners from any claims, damages, liabilities, losses, costs, and legal expenses arising from:

• Your use of the Platform;
• Your content;
• Your business activities;
• Your breach of these Terms;
• Violations of applicable law.

Yachtwize may suspend, restrict, or terminate access without notice if:

• These Terms are violated;
• Fraudulent activity is suspected;
• Payment obligations remain outstanding;
• Legal or regulatory requirements necessitate action.

Termination does not remove obligations accrued before termination.

We may update these Terms periodically.

Updated versions will be posted on the Platform with a revised effective date.

Continued use of the Platform following publication constitutes acceptance of the updated Terms.

These Terms shall be governed by and interpreted in accordance with the laws of the United Arab Emirates and the Emirate of Abu Dhabi.

Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Abu Dhabi, United Arab Emirates.
